Terms and Conditions
HIM Competition
These terms and conditions govern entry into the HIM competition
organised by Sony BMG Music Entertainment (UK) Limited (‘Sony BMG’) of Bedford
House, 69-79 Fulham High Street, London SW6 3JW (the “Competition”).
By participating in the Competition, you agree to be bound by these terms
and conditions, by all rules applicable to the Competition and by our decisions
with regard thereto:
You confirm that you are resident in the UK or Republic of Ireland
and that either you or your chosen companion, or both of you,
are over eighteen (18) years of
age. A valid passport will be required as proof of age.
Cash alternatives are not available and prizes are non-refundable and
non-transferable.
Employees (or family members of employees) of Sony BMG, companies associated
with the Competition and/or affiliates of such companies may not enter
the Competition.
Sony BMG reserves the right to substitute a prize of like value in
the event that any awarded prize is unavailable for any reason
whatsoever.
Sony BMG and its directors, officers and employees shall not be liable
in any way whatsoever for any damage, loss or injury caused or for
any failure
or
breach by any party in connection with the Competition and the prize
(as set out in
clause 7 below) save in respect of death or personal injury arising
from Sony BMG’s negligence.
If you are not able for whatever reason to accept the prize then
Sony BMG reserves the right to award the prize to another participant.
The prize shall consist of:
two (2) flights from London to Helsinki on Friday, 29th December
2006 (the exact travel times and details to be notified by Sony BMG
to you,
and all regulations
and restrictions printed on and relating to the relevant tickets
will apply and be binding on the winners, and any alterations to
the said
tickets will be at
the expense of the winners) and returning on Tuesday, 2nd January
2007;
two (2) tickets to see HIM perform at The Tavastia in Helsinki on
Sunday, 31st December 2006;
four (4) nights accommodation at the Scandic Hotel Simonkentta in
central Helsinki.
For the avoidance of doubt the prize set out in this clause 7 shall
be the entire prize to be taken as between the winner and their chosen
companion.
You hereby consent to filming and sound recordings being made during
the enjoyment of the relevant prize and to the exploitation thereof
by Sony BMG in any and
all media throughout the world in perpetuity without any payment
to you whatsoever.
Sony BMG shall NOT be providing travel insurance. The winner and
their chosen companion must arrange their travel insurance themselves.
For the avoidance of doubt you are solely responsible for any and
all expenses not included in the prize as set out in clause 7 above
including
without limitation
transfers and airport taxes.
You must have a credit card for the check-in at the hotel.
In all cases Sony BMG shall not be liable for tickets and/or prizes
that do not reach the winners for reasons beyond Sony BMG’s
reasonable control.
You will be required to take part in any PR activity in connection
with the Competition as reasonably determined by Sony BMG.
These terms and conditions are governed by the laws of England and
Wales and the courts of England and Wales shall be the sole courts
of competent
jurisdiction.
Before accepting the prize you are required to sign a copy of these
terms and conditions and in doing so shall be bound by them.
The Contracts (Rights of Third Parties) Act 1999 shall not apply
to this agreement or to any of its provisions.
