"Faithless ‘No Roots – The Remix Collection’ Artwork Contest"

Official Rules for Entry

1. NO PURCHASE NECESSARY TO ENTER OR WIN.

2. ELIGIBILITY RESTRICTIONS:
"Faithless ‘No Roots – The Remix Collection’ Artwork Contest" (the "Contest") only open to legal United Kingdom residents who reside and are physically located in the United Kingdom or Eire. Employee’s, officers and directors (including immediate family of employees, officers and directors) of BMG UK & Ireland Limited ("BMG") or Selfridges & Co. (“Selfridges”) as well as any affiliated company, subsidiary, distributor, dealer, retailer, co-sponsoring companies and/or any contractor associated with BMG and/or Selfridges and/or this Contest, or any other affiliated promotion are not eligible to participate. All Contest entries must comply with the requirements of these official rules to be eligible to participate.

3. ENTRY DATES AND DEADLINES:
Contest opens on 30 July 2004 and closes on 13 August 2004.

4. TO ENTER:
Using the Faithless logo (the “Logo”) if you wish (but you are not obliged to), which shall be available to download from Faithless’s website (www.faithless.co.uk) (the “Website”), design an album sleeve (which must be the size of a standard compact disc album sleeve – 120mm x 120mm) for the Faithless ‘No Roots – The Remix Collection’ album (the “Album”). Your entry (which must be submitted with your full name, complete home address (including postcode), phone number (including area code), e-mail address (if applicable) and age) may be submitted in the following ways:

(a) by hand at the competition entry point at Selfridges (London, Birmingham or Manchester);

(b) by post, to BMG UK & Ireland Limited, Bedford House, 69-79 Fulham High Street, London SW6 3JW Attn: Faithless ‘No Roots – The Remix Collection’ Artwork Contest; or

(c) by email (attaching your entry in jpeg or pdf format) to faithless@bmg.com.

By participating all entrants agree to abide by these official Contest rules and warrant that they meet the eligibility requirements set forth herein.

5. GENERAL CONDITIONS:
Limit one (1) entry per household and/or unique e-mail address. Neither BMG nor Selfridges nor their agencies are responsible for lost, late, damaged, misdirected, illegible, incomplete entries, interrupted or unavailable network, server, Internet or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic or for exposure to computer viruses or for damage to participant's computer by accessing the Website. Without limiting anything to the contrary contained herein, BMG makes no warranty that any particular artwork software program or file will function as required for the Contest. It is your sole responsibility to ensure that your system(s)and/or file format(s) function correctly. You agree that all entries shall be the sole property of BMG and will not be returned. You hereby agree not to duplicate, sell or exploit the Logo at any time without BMG's prior written consent, such consent to be given or refused at BMG’s sole discretion. Personal information supplied on registration forms will be used to communicate with participants about this Contest, for market research, and to send information about BMG events, releases and other news and promotions that BMG may judge of interest to participant. BMG reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond BMG’s reasonable control impairs the integrity of the Contest as determined by BMG in its sole discretion. BMG reserves the right to change the prize in its sole discretion at any time.

By entering this contest, and for other good and valuable consideration receipt and sufficiency of which is hereby acknowledged, you expressly agree that all of the results and/or proceeds of the Contest entry are and shall be the sole property of BMG. You further acknowledge, certify and agree that BMG shall be deemed the creator and/or the exclusive owner throughout the world of any and all rights in and to the entry (including, but not limited to, the right, title and interest in and to the worldwide copyrights in the entry (as such are defined in the Copyright, Designs and Patents Act 1988) and any renewal or extension of rights in connection therewith), and of any and all other rights thereto. To the extent that you acquire any rights in or to the results and/or proceeds of this Contest entry then you hereby agree that all such rights therein shall be deemed irrevocably assigned to BMG by virtue of this agreement. You will, upon request, execute, acknowledge and deliver to BMG such additional documents as BMG may deem reasonably necessary to evidence and effectuate BMG’s rights hereunder.

You hereby warrant that, other than in respect of the Logo, you have all necessary rights to use all constituent parts and/or any other elements which combine to form your entry and you hereby indemnify BMG and Selfridges from and against any and all loss, damage or expense suffered by BMG and/or Selfridges which result from a breach of your warranty set out herein.

BMG reserves its rights to verify eligibility qualifications of any entrant and to disqualify any entrant found, in its sole discretion, to be tampering or otherwise interfering with this Contest. Any entrant found to be misrepresenting themselves through the use of aliases and/or addresses or an entrant's submission of mass entries and/or reproductions will be disqualified. Except where prohibited by law, by participating in this Contest, you are granting BMG, and those acting under its authority, permission to use your name, photograph, voice and/or likeness for advertising, publicity and/or other business purposes in connection with the Contest without compensation.

6. JUDGING:
Eligible entries will be judged by a panel consisting of employees of BMG, Selfridges, Cheeky Records and Metro selected for their expertise in the music business and associated artwork creative elements. The judging process will be completed by 23 August 2004. Prior to this date, the judges will choose a shortlist of six entries. The six shortlisted entrants will be contacted and required to sign a copy of these terms and conditions prior to the judges selecting the winning entrant (the “Winner”). If any entrant on the shortlist is under the age of 18, their parent or legal guardian must review and sign these terms and conditions on behalf of their son/daughter. Once the judges have chosen the Winner, the Winner and the five runners up will have their names set out on the Website and have their names printed in Metro newspaper. Depending on the quality of the Winner’s entry (such quality to be judged solely by BMG) BMG may elect in its sole discretion to display the Winner’s entry on a 48-sheet billboard and use it as the album art for the Album.

7. NOTIFICATION:
The Winner will be notified by telephone and/or e-mail by the close of business 23 August 2004.

8. LIABILITY:
Winner agrees that BMG and/or Selfridges and their affiliated companies, parents, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents will have no liability whatsoever, and will be held harmless by Winner for any liability for any injuries, losses or damages of any kind to persons and property resulting in whole or in part, directly or indirectly, from the participation in this Contest.

9. RULES:
Entrants should print out a copy of these official Contest rules for future reference. To receive a copy of these official Contest rules by post, send the request with a self addressed stamped envelope to BMG UK & Ireland Limited, Bedford House, 69-79 Fulham High Street, London, SW6 3JW, Attn:, Official Rules.

10. WINNER LIST:
To obtain the name of the Overall Winner, send the request with a self addressed stamped envelope to: BMG UK & Ireland Limited, Bedford House, 69-79 Fulham High Street, London, SW6 3JW Attn: Faithless ‘No Roots – The Remix Collection’ Artwork Contest Winner List.

12. LAW:
This Contest and these official Contest rules shall be governed by the law of England and the High Court of Justice shall be the sole court of competent jurisdiction.

13. MISCELLANEOUS:
The Contracts (Rights of Third Parties) Act 1999 shall not apply to these official Contest rules or to any of their provisions
